Silent Features of the Constitution of Bangladesh

There are certain salient features of the constitution of Bangladesh. The constitution of the People’s Republic of Bangladesh lays great emphasis on the principle of secularism. The preamble of the constitution says that the higher ideas of secularism, nationalism, socialism, and democracy shall be the fundamental principles of the constitution. According to Article 8
secularism, nationalism, socialism, and democracy are the fundamental principle of state policy.

Written and Rigid Constitution

The constitution of Bangladesh is a written document. It contains 153 articles, 1 Preamble, and 4 schedules.

But remember that it is a rigid one. It can be amended by an ordinary lawmaking procedure.

Preamble

Preamble introduces with the constitution. It helps to understand the constitution. Bangladesh is not an exception to that. The preamble of the Constitution of Bangladesh starts with a preamble. It is the guiding star of the constitution of Bangladesh. The Preamble contains the moral basis of the constitution. It identifies the aims and objectives of the constitution of the People’s Republic of Bangladesh.

Unitary Governmental System

Article 1 of the constitution provides that Bangladesh is a unitary one. Since all powers centralized to a unitary government under the Constitution. The constitution is the supreme law of Bangladesh. If any law goes against the constitution it will declare as unconstitutional.

Independent Judiciary System

Another Silent Features of the Constitution of Bangladesh is an independent Judiciary system. Firstly, the chief justice is appointed by the president, therefore he is independent. Secondly, Parliament cannot remove the judges.

Article 41

Article 41 of the constitution of Bangladesh provides that every citizen has the right to profess, practice or propagate any religion. Every religious community or denomination has the right to establish, maintain and manage its religious institutions.

No person attending any educational institution shall be required to receive religious instructions to attend any religious ceremony or worship if that instructions or ceremony or worship relates to a religion other than his own.

But Pakistan has set up an Islamic Republic.

The constitution of Bangladesh provides declares that the executive power of the Republic shall be exercised by or on the authority of the prime minister, although all actions of the government shall be expressed to be taken in the name of the President. Therefore the president act in accordance with the advice of the Prime Minister.

The constitution provides the deterrent against the defection of legislatures from one another party. If a person elected as a member of a parliament as a party member. But after elected if he goes against the party and votes against their decisions then also no one can cancel his membership from parliament. That means he can continue as a parliament member.

Fundamental rights

The constitution of Bangladesh has also talked about fundamental rights. Parliament can not pass any law that goes against it. It guaranteed by part III of the constitution.

The constitution provides Bangladesh as a unitary, independent and sovereign republic. It is also known as the People’s Republic of Bangladesh.

The previous name of Bangladesh was East Pakistan. After Independent Bangladesh made their constitution. Before independent it was Islamic country. But now it is Republic country.

Part II of the constitution deals with Fundamental principles of state policy. The fundamental principles are secularism, nationalism, socialism, and democracy.

According to the constitution, it is the right of every citizen that they can form associations or union.

Attorney General

President appoint to Attorney general. And he performs duties given by president.

On 25th January 1975, the constitution of Bangladesh was amended. according to new constitution people directly elected to president. But there was an exception for Mujibur Rahaman. He is known as Bangabandhu.
